credit debt
terrortwilight asked:

I was issued a summons to appear in court for a credit card debt, how can I settle out of court? I live in Illinois and I had a credit like with Capital One.

Call ‘em up and make an offer. Lump sum gets the best deals. Payment plans have to be very short term. Get any settlement agreement in writing before you pay. Don’t give the collector direct access to your bank account.

You still might be able to settle for less than the full balance, but Capital One is very aggressive and will proceed to court. They will then win a judgment. With the judgment they can attach your bank accounts, garnish your wages, and lien your property.

Before sending you to court they should have approached you one last time to settle your bill. That is what happened to me, credit company sent me a letter that they are going to take me to court unless if i call them and made arrangements to pay the balance. The letter that they sent to me seemed fake so i called my city court to see if a court date was actually scheduled, and it was. So i quickly called them up and made arrangements to pay. This is very important! if you go to court and they win, more than likely they will not only want you to pay the debt but will also make you pay their lawyers fee. Be very careful and make every effort to settle before court.
